Terms of Use for GentleBridge

These Terms of Use ("Terms") constitute a legally binding agreement between you and GentleBridge ("GentleBridge", "we", "our", or "us"), governing your use of our mobile application, website, dashboard, and related services (collectively, the "Services").

By using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use the Services.

1. Eligibility and Intended Use

The Services are intended for use only by adults who are:

• Parents or legal guardians of children; or
• Authorized educators, therapists, or caregivers acting with parental consent.

You must be at least 18 years of age to create an account or access any parent-facing or administrative features of the platform. Children do not create accounts or submit information themselves.

2. Nature of Services

GentleBridge provides AI-powered task reminders, speech prompts, and structured conversations to help children develop daily routines and practice communication. These Services are:

• Non-clinical, non-diagnostic, and non-therapeutic in nature
• Designed as a supportive supplement to parental care and professional interventions
• Not a replacement for supervision, therapy, medical care, or emergency services

You agree that you will not rely on GentleBridge to monitor your child's behavior, health, safety, or well-being.

3. Parent/Caregiver Responsibility

You explicitly acknowledge and agree that:

• You are solely responsible for supervising your child's use of the Services
• You are responsible for configuring, reviewing, and monitoring all tasks, prompts, and content
• You will not allow your child to use the Services unsupervised
• You will not rely on the Service as a substitute for your involvement, judgment, or care
• You accept all responsibility for any consequences arising from your or your child's use or non-use of the Services

4. Use of Third-Party Services and AI Providers

GentleBridge uses third-party platforms and AI services, including but not limited to:

• OpenAI for conversational interactions
• Google Cloud for AI voice synthesis and analytics
• Amazon Web Services (AWS) for secure data hosting and infrastructure

You understand and accept that these third parties may process limited data as part of providing core Services, subject to contractual data protection and security terms.

5. Prohibited Uses

You agree not to:

• Use the Services to monitor, track, or diagnose children in a clinical or medical capacity
• Input sensitive personal health data, educational records covered by FERPA, or PHI covered under HIPAA
• Share offensive, abusive, illegal, or harmful content through the platform
• Use the Services in violation of any applicable law, child protection regulation, or privacy statute
• Reverse engineer, scrape, copy, or resell any part of the Services

6. Data and Privacy

Your data is governed by our Privacy Policy. By using the Services, you consent to our collection, use, and sharing of information as outlined in that policy. We process limited personal information for the sole purpose of delivering the Services.

We encourage the use of pseudonyms for children and strong data minimization practices. You may delete your data at any time through your account or by contacting us.

7. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranty of any kind. We make no guarantees regarding:

• Availability or performance
• Effectiveness of prompts or routines
• Behavior, communication, or developmental outcomes
• Error-free or uninterrupted operation
• Accuracy of AI-generated outputs

GentleBridge is not a medical or therapeutic platform and should never be relied upon as such.

8. Limitation of Liability

To the maximum extent permitted by law, GentleBridge and its affiliates shall not be liable for:

• Any indirect, incidental, special, punitive, or consequential damages
• Any injury, harm, or event arising from your child's behavior or failure to follow a prompt
• Loss or corruption of data
• Reliance on AI responses or automated communications
• Issues caused by third-party integrations or service providers

Our total liability to you for any claim shall not exceed the amount you paid to GentleBridge in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless GentleBridge, its officers, employees, and partners from and against any claims, liabilities, damages, or costs (including attorneys' fees) resulting from:

• Your misuse of the Services
• Your violation of these Terms
• Your failure to supervise your child
• Any content or inputs submitted by you to the platform

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your access to the Services will cease, and we may delete your data after a retention period.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in courts located in California.
